What is the difference in a court of law between a "petition" and a "motion?"?

What is the difference in a court of law between a "petition" and a "motion?" When would the petitioner submit a petition and when would the petitioner submit a motion? The differences? Thanks!What is the difference in a court of law between a "petition" and a "motion?"?They are pretty close; you are trying to persuade the court to do something in your favor. However, generally a motion usually needs a motion hearing, with oral arguments by both sides; a petition can generally be decided by the judge without an actual hearing.

  1. My lawyer filed a motion to modify child support in AZ but was unable to serve my ex by process server. He wouldn't answer the door. So he emailed and mailed him copy. He definitely got it because he filed a response and asked for a continuance which was granted. Now he's asking it to be dismissed because he wasn't properly served. What do I do?
