My finances child's mother is trying to file a motion to increase her child support according to how much?

My finances child's mother is trying to file a motion to increase her child support according to how much I make. Can she do that in the state of NJ? Also if a court order is drafted stating how much she is to pay for Day Care and she is actually keeping the child out of Day Care and pocketing the money what can we do about it?My finances child's mother is trying to file a motion to increase her child support according to how much?It called a REBUTTABLE PRESUMPTION ARGUMENT. It means a judge is required to at least consider options outside those set down by the guidelines to order an amount not in keeping with them. However, that applies to both an increase AND/OR decrease in the order. As such, if the judge accepts the motion, your man can make a counter argument for paying less.

As for the Day Care, just subpoena the receipts, or if it's a person, their tax records. So, want to learn how to fight back?

The fact that you don't have any legal ties to the child should be enough to squash the case. Especially since you are not even married yet! But the fact is every 3 years everyone has the right to take the case back to court to see if they can get some more money, or in some cases, see if they can now pay less money!

Your fiance can have it added to the court order that daycare costs will only be paid to a licensed daycare facility and only to the actual daycare. This should limit the amount of wiggle room the ex has.My finances child's mother is trying to file a motion to increase her child support according to how much? You should be able to check online in your county of the child support laws. I would consider doing that. I am from Illinois and here, child support is solely based on the biological parents. Meaning there can be no raise in child support based on the new spouses income. There can only be an increase or decrease based on the biological parents income. My finances child's mother is trying to file a motion to increase her child support according to how much?
If she can prove you are adding to the fiance's income, heck yeah she can do that. NJ and you - hands in your pocket! The child care thing is nice ammo for you. If you can prove she's not spending money the way it's intended, it's a point in your fiance's favor. Why doesn't he write checks directly to Child Care, btw?My finances child's mother is trying to file a motion to increase her child support according to how much?I am assuming you mean fiance? Your income has nothing to do with child support so it will not affect anything. 'We' can do nothing, but your fiance can file a motion to have the child support adjusted according to the no day care issue. My finances child's mother is trying to file a motion to increase her child support according to how much?
