Do I have to notify the plaintiff with a motion before filing a subpoena?

I want to subpoena duces tecum the plaintiff for production of documents in Florida small claims court.

Do I have to file a motion to let plaintiff know before filing and issuance of the actual subpoena? Do I have to type myself the order of issuance of the subpoena or the judge that grants will have that paperwork?Do I have to notify the plaintiff with a motion before filing a subpoena? No. You don't need to notify the plaintiff. Just file the subpoena request form for small claims. Go to the court clerk's office where you live and get an Information packet for small claims court. It will tell you how to subpoena a witness or documents.
